What if the NCAA combines all the cases open against Michigan—burgergate (illegal recruiting), exceeding permissible coaching time by using Zoom, illegal advance scouting (sign stealing) and refusing to cooperate with an NCAA investigation, throwing in Michigan’s unexplained terminations of Connor Stalions and Chris Partridge. Then they call the combined case a Level 1 Loss of Control and bring it before the full Committee on Infractions. Actually, that appears to be exactly the direction the NCAA seems to be headed.

It’s not unreasonable to assume that the COI would punish Michigan with a package of penalties including reduced scholarships, limits on coaching time, reduced recruiting time, reduced recruit visits and a show cause order calling for either the termination or suspension of Jim Harbaugh for multiple years.

Were that to happen, Michigan would have no option except to terminate Harbaugh. That’s exactly the scenario why Harbaugh is demanding immunity protection and why the University is seeking to avoid a Charlie Weiss or Jimbo Fisher situation where they would be obligated to continue to pay Harbaugh for the full term of his contract.

Is this scenario one that’s unlikely to happen? By the NCAA refusing to seek a negotiated settlement on the allegations against Michigan it actually appears that is exactly the direction they seem to be headed.

So answer these questions…

— If you were Jim Harbaugh, would you be seeking the contractual protections of his contract (Immunity)?

— If you were President Ono or a Regent would you endorse entering into a contract with Harbaugh that didn’t protect Michigan from a similar situation which cost Notre Dame and Texas A&M tens of millions of dollars because their contracts with their coaches did not have contractual protections.

Therein lies the stalemate between Michigan and Harbaugh. Unless the parties agree on terms which limit the damages to both parties—maybe a limit on damages of 1-2 years—the contract negotiation may well be at an impasse. This won’t change, even if Harbaugh calls off NFL Job Search ‘24.

If everyone is innocent, why is immunity a demand for JH? Seems to be a CYA clause.

Considering the transfer portal is open to players on a team for 30 days after a coach leaves.

It looks like that one is down, and all eyes are on the Chargers, though they are interviewing Dan Quinn on Friday and have a strong track record of hiring coordinators.

When will they learn? It's not about this move or that move in recruiting or the portal. It's about player development and system culture. Texas isn't there...yet. Michigan lost more than a few pieces but they have more than a few coming back. If the core of the program stays (Herbert's strength and conditioning program) and they have some leaders in the locker room step into leadership positions vacated by JJ, Sainristil, Corum, Zinter, etc., they'll be just fine. Donovan can and should develop into that. Moore and CB1 can step into that. G&G at DT should step into that. The defense has potential to be better than this last year if the younger guys can develop into some key depth. Offensively, there are a few more questions to answer, particularly at QB, but that isn't due to lack of talent or ability, just playing time. They're going to be more than fine at RB and WR. Hinton and El-Hadi both have game experience on championship teams on the OL.

Intangibles were where this last team had an advantage over its competition. If they're going to be as successful next year, that will remain true and right now, there's little to no reason to believe that locker room isn't full of aspiring leaders that will take ownership of Team 145.

...the better I feel about him coming back. Heard this on the most recent Cover 3 podcast, but it makes sense. If you're an NFL team, I feel like you either want Harbaugh that badly or you don't. You make it happen immediately to lock him up and, paradoxically, prevent him from staying at Michigan. Why wait if you're the Chargers? So he can maybe go to Washington, Atlanta, or stay at Michigan? No. You roll out the red carpet and give him the keys to the kingdom immediately. I feel like odds are increasing, as every day passes, that he stays.

The reported immunity clauses requested by Harbaugh is another wrinkle. The NCAA changed the rules related to suspensions, penalties for head coaches, etc. if anyone on the staff commits a violation. I believe many coaches will start to request these clauses. I just think this is Harbaugh wanting more protection and is smart. I do not believe it is some ploy to make it look like Michigan fu**ed up in the event he leaves. I think it is a pragmatic move, especially if you're in JH's shoes.
