We just hired a contractor to replace a couple of doors for us back in the beginning of May. We signed a contract with him that had estimates for all of the materials and the cost of labor. When he went to order one of the doors, he told us that it was on back order and wouldn’t be in till July. At that time we decided to go with a different door. The original door in the contract we signed was cost at $1800. The new door we ended up going with instead was only $600. He is now trying to hold us to the contract saying we agreed to pay $1800 for the door and it’s not his fault we decided to not wait till July for it and going with a door that was only $600. We withheld our last payment for his labor of $1100. He said he is going to put a lean on our house and take us to court. It was our fault for not having the contract amended when we switched doors. But at the same time, we did not get the door that we had signed the contract for or that is in the original agreement. If we pay the remaining balance, he will have gotten $2200 in labor from us and then made a extra $1200 on the door that we did not get. Are we right in withholding his last payment and refusing to pay the $1800 for a $600 door that we got.
