A 13-year-old boy at my daughter's school sent a nude photo of himself to his girlfriend. He broke up with her and she put the picture on her snapchat timeline. The disgruntled girlfriend and her friends wrote a written statement stating that my daughter posted the picture.
The school
1. held my daughter out of class for three hours and questioned her without calling us or having counsel present.
2. Had her sign a statement again without parents or counsel present.
3. confiscated her phone and turned it over to police.
4. pulled her from her athletic practice and informed the coach she was not allowed to practice until she is cleared.
The picture was not taken or posted on social media on school grounds or school activity.
My daughter had blocked this girl on snapchat a year ago and never saw the photo.
Is it time to lawyer up? What legal options do I have?
