Let's just take this logic. Every victim of Mr. Fogle from 'x' point on can sue the corporation over allegations? Is Subway the police? Why wouldn't someone who thought Fogle was a pedophile not just call the police.

Why would you expect Subway to investigate the sexual assault allegations of one of it's employees. I thought Subway makes sandwiches and not child porn. I don't know if I want an employer investigating it's employees from customer allegations or rumors. Call the police.

How does this relate to the PSU situation?

having dealt with attorneys, watched one of my guys open the 2014 U.S. Supreme Court (opening day, opening case), at the California Supreme Court and three visits to the Ninth Circuit Court of Appeals, plus countless lower court visits, I've learned one thing:

Anyone can sue about anything.

But it seems like the Courts are trying to turn a new leaf on bad lawsuits. If you followed the Colorado movie theater shooting, a dozen or so plaintiffs sued he movie theater. Despite receiving several notices that there probably wasn't a good case, the plaintiffs pushed forward. Now they owe $750,000 in court and defendant damages.
